Terms of Service
Last updated: 19 May 2026
These Terms of Service (the “Terms”) govern access to and use of the HoReCa Market mobile application and the website horeca-market.kz (together, the “Service”).
The Service is operated by Individual Entrepreneur “The Frozen Bits Studio”, IIN 930319350084, trading under the name HoReCa Market (the “Service Provider”, “we”, “us”, or “our”).
By downloading, registering for, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Purpose of the Service
HoReCa Market is a B2B marketplace that helps suppliers connect with restaurants, cafés, hotels, and other hospitality businesses operating in Kazakhstan.
The Service allows businesses to create profiles, browse catalogues, publish products, place orders, receive orders, communicate with counterparties, and coordinate fulfilment.
2. Eligibility
The Service is intended only for:
- legal entities;
- individual entrepreneurs;
- authorised representatives of legal entities or individual entrepreneurs;
- users who are at least 18 years old.
By registering or using the Service, you confirm that:
- you are authorised to act on behalf of the business whose information you provide;
- the information you provide is accurate, complete, and up to date;
- your use of the Service is for business purposes and not for personal consumer purchases.
We may refuse, suspend, or terminate access if we reasonably believe that a user is not eligible or is acting without proper authority.
3. Accounts and authentication
Users sign in using a phone number and SMS one-time password (OTP). One account may be associated with one phone number unless we approve otherwise.
You are responsible for:
- keeping control of the phone number used to access the account;
- protecting SMS codes and not sharing them with third parties;
- ensuring that account users are authorised by the relevant business;
- promptly notifying us of unauthorised access or suspected account compromise.
We recommend that you do not jailbreak, root, or otherwise compromise the security model of any device used to access the Service, as this may expose your account and data to malware or unauthorised access.
4. Business information and user content
You may submit business information, product information, prices, photos, images, descriptions, addresses, and other materials through the Service (collectively, “User Content”).
You are responsible for ensuring that User Content:
- is accurate, lawful, and not misleading;
- does not infringe third-party rights;
- does not contain unlawful, harmful, fraudulent, or offensive material;
- complies with applicable advertising, product, tax, trade, consumer-protection, and other laws.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, process, and transmit User Content only as reasonably necessary to operate, provide, support, secure, and improve the Service.
You retain ownership of your User Content, subject to the rights granted to us under these Terms.
5. Acceptable use
You must not:
- use the Service for unlawful, fraudulent, misleading, or unauthorised purposes;
- impersonate another person or business;
- place fictitious, test, spam, or bad-faith orders in a live environment;
- publish false, inaccurate, offensive, or infringing content;
- scrape, crawl, copy, bulk-download, or extract catalogues or data without our prior written consent;
- reverse-engineer, decompile, modify, or create derivative works from the Service, except where such restriction is prohibited by law;
- interfere with, disrupt, overload, scan, or attempt to compromise the Service or its infrastructure;
- bypass security, authentication, rate limits, or access controls;
- use the Service to transmit malware, spam, or harmful code;
- misuse trademarks, logos, branding, source code, designs, or other intellectual property belonging to us or third parties.
We may investigate suspected violations and may suspend or terminate access where reasonably necessary.
Report abuse or violations to support@horeca-market.kz. We aim to review abuse reports within 3 business days.
6. Marketplace role and counterparty transactions
HoReCa Market provides a platform that connects buyers and suppliers. Unless expressly stated otherwise, we are not the seller, buyer, distributor, courier, payment processor, manufacturer, importer, or guarantor of goods listed or ordered through the Service.
Any supply, purchase, delivery, payment, warranty, refund, return, quality, quantity, or compliance obligation is agreed directly between the buyer and the supplier.
The contract for goods or services is concluded between the relevant buyer and supplier. We may provide technical tools, communication features, order records, notifications, and support, but we are not a party to transactions between users.
Users are responsible for resolving disputes with counterparties. We may, at our discretion, help facilitate communication, but we do not guarantee any outcome and do not assume responsibility for counterparty performance.
7. Payments
Payments for orders are made outside the Service, directly between buyer and supplier, unless we introduce an in-app payment feature in the future.
Examples of outside-the-Service payment methods may include:
- cash on delivery;
- bank transfer;
- payment through a courier’s POS terminal;
- other payment arrangements agreed directly between buyer and supplier.
We do not currently process in-app payments, store payment card details, or act as a payment intermediary for marketplace transactions.
8. Third-party services and platform terms
The Service may rely on third-party platforms and services, each of which may apply its own terms and policies, including:
- Google Play Services and Google Play;
- Apple App Store and Apple platform services;
- Expo;
- Sentry;
- Datadog;
- Mobizon;
- Resend;
- AWS S3 and/or Yandex Object Storage;
- mobile network operators and internet providers.
Your use of the Service may require an internet connection. Your mobile operator or internet provider may charge for data, roaming, SMS, or other services. You are responsible for those charges.
9. Updates, availability, and changes to the Service
We may update, modify, suspend, or discontinue all or part of the Service at any time.
Some features may require:
- an active internet connection;
- a compatible device;
- a supported operating-system version;
- sufficient battery and device storage;
- access to third-party services.
We make reasonable efforts to keep the Service available and reliable, but we do not guarantee uninterrupted, error-free, or continuously available operation.
We may require users to install updates to continue using the Service. If you do not install required updates, some or all features may stop working.
10. Account deletion and termination
You may request account deletion at any time:
- inside the Application: Profile → Delete account;
- by email: support@horeca-market.kz;
- through the web page: /en/delete-account.
After account deletion, personal identifiers such as contact person name and phone number are deleted or anonymised within 30 days, unless retention is required or permitted by law. Order history may be retained in anonymised or business-record form for up to 5 years where necessary for tax, accounting, audit, dispute-resolution, or counterparty record purposes.
We may suspend or terminate access to the Service if:
- you violate these Terms;
- you provide false or misleading information;
- your use creates legal, security, operational, or reputational risk;
- we are required to do so by law or by a competent authority;
- the account appears inactive, compromised, or unauthorised.
Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination will continue to apply, including intellectual property, marketplace role, disclaimers, limitation of liability, governing law, and dispute-resolution provisions.
11. Intellectual property
The Service, including software, source code, interface, design, databases, trademarks, logos, text, and other materials, is owned by or licensed to the Service Provider and is protected by applicable intellectual-property laws.
Except for rights expressly granted in these Terms, no rights are transferred to you. You may not copy, modify, distribute, sell, rent, sublicense, or exploit any part of the Service without our prior written consent.
12. Privacy
Our processing of personal data is described in our Privacy Policy. By using the Service, you acknowledge that we process data as described in that policy.
13. Disclaimer of warranties
The Service is provided “as is” and “as available”.
To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.
We do not guarantee that:
- the Service will be uninterrupted, secure, or error-free;
- catalogues, prices, availability, product descriptions, order information, or counterparty information will always be accurate or up to date;
- any buyer, supplier, courier, or other counterparty will perform its obligations;
- the Service will meet your specific business requirements.
14. Limitation of liability
To the maximum extent permitted by the law of the Republic of Kazakhstan, the Service Provider is not liable for:
- indirect, incidental, special, punitive, or consequential damages;
- lost profits, lost revenue, lost business opportunities, loss of goodwill, or loss of data;
- disputes between buyers and suppliers;
- product quality, safety, legality, availability, delivery, payment, refund, or warranty issues between counterparties;
- failures caused by your device, network, carrier, third-party services, force majeure, or circumstances outside our reasonable control.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. Indemnity
You agree to indemnify and hold harmless the Service Provider from claims, losses, liabilities, damages, costs, and expenses arising from:
- your violation of these Terms;
- your User Content;
- your transactions or disputes with counterparties;
- your breach of law or third-party rights;
- unauthorised use of the Service through your account caused by your failure to protect access credentials or OTP codes.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Kazakhstan.
The parties will first attempt to resolve disputes through good-faith negotiations. If a dispute cannot be resolved through negotiation, it will be submitted to the competent courts at the location of the Service Provider, unless another venue is required by applicable law.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users, such as by updating the Application, posting a notice, or revising the “Last updated” date above.
Continued use of the Service after changes become effective means that you accept the updated Terms.
